As set forth above, as between VA and NC, only Virginia specifically and explicitly provides for damages to the beneficiaries for sorrow and mental anguish; however, the North Carolina Statute is far broader and includes many areas which will allow the jury to award damages for loss of society, companionship, comfort, etc of the deceased. While you cannot technically be compensated for your ‘pain’ or ‘anguish’ directly in NC, you can still be compensated for the loss of everything the decedent was to you and would have been to you had he or she not be taken from you by the defendant(s).
