As stated above, in Virginia, grief and anguish of the beneficiaries is compensable, in NC, it is not; however, as a practical matter, there is nothing wrong with doing anything and everything to keep yourself sane during the process. We would always have frank discussions with our clients, however, about what points of discussion with therapists are off limits. Comments for instance such as “I just want this whole thing over with,” will encourage the insurance company to make low ball offers on the claim.
