Workplace Injury Frequently Asked Questions

WARNING: All of the information provided here is of a general nature only. The specific facts of your case may require a completely different answer. Do not base any decision with respect to your case solely on any of the answers found herein. Prior to making any decision with respect to your case, you should speak with a competent attorney who is familiar with the laws that relate to your case.

How long will it take until I can expect to receive a result from my Workers Compensation Case?

Answer: That is going to vary greatly, depending on many factors, including, but not limited to your stage of treatment, whether you are already under an Open Award, the willingness of your employer to cooperate in moving toward a resolution of your case, or whether you have a situation which requires us to move forward with an immediate, expedited hearing.

You should be aware that the Workers Compensation Commission does not operate at all like your local courthouse, where you can just go down and take out a warrant against someone, or have a hearing scheduled within a few weeks. It can be a fairly long process. Even when we ask for an expedited hearing, we will not usually get a hearing date until at least one or two months at the earliest.
