Joe Miller Obtains $1.2 Million Jury Verdict for TN Railroad Signalman Against CSX
2001, Big Stone Gap, Va.—Along with our friend and local counsel, Terry Kilgore, we obtained a $1.2 Million Jury Verdict won at Trial in an FELA case for railroad signalman with an ankle injury requiring screws and internal fixation. The signalman had actually fallen off of his own hi-rail truck provided by the railroad; however, investigation revealed that a non-skid tape had previously been requested from the railroad for all hi-rail trucks, and not provided. In addition, further evidence revealed that the tape was provided to all hi-rail truck drivers by the railroad the day after our client fell. As permitted by FELA law, the verdict was reduced by one-half due to our client’s contributory negligence in getting off the truck.
