The Vocational Rehabilitation Counselor is subject to the Virginia Worker’s Compensation Law. This means the VCR has to follow these Commission Rules for his recommendations to be valid. Some of the things a VCR cannot do are:
Require that the employee apply for jobs, the VCR knows do not meet the physical restriction requirements. If the employee restriction by the doctor says the employee should not lift objects over 10 pounds, then the VCR cannot line up a job that requires a worker lift 25 pounds.
- Require that the employee apply for too many jobs at one time. Asking the employee to fill out 50 applications each week is too much.
- Requiring the employee to look for work when his/her medical condition has not reached maximum improvement or when the employee has not be released by the doctor to do any type of work.
- Asking the employee to apply for a job that the VCR knows the employee is not qualified for because the employee does not have the proper training or education
