Glossary of Virginia Worker’s Compensation Commission – A’s

Alternative Dispute Resolution: This is a way for the worker and employer to try to reach an understanding without a formal hearing. It is also called a mediation. It is a confidential and voluntary process. A neutral person, a mediator, helps the parties try to identify the issues, clarify misunderstandings and work towards solutions. Either side, employee or employer, can request a mediation.

 

American Medical Association (AMA): A nationwide medical group that creates the book Guides to the Evaluation of Permanent Impairment. Doctors unusually use these guidelines to determine a worker’s impairment level, which is typically expressed as a percentage. Virginia usually follows the 6th Edition.

 

Amputation Chart: A form that doctor completes to show exactly where the amputation is.

 

Appeal: The way a worker or employers requests that a higher Virginia court review a lower court decision.

 

Assertion of Rights: Workers should not assume that because the employer pays any benefits, that payments will continue. The Assertion of Rights is part of the Claim for Benefits form. By filling out this section, the worker lets the Commission know that that the worker wants to protect his/her rights.
