Glossary of Virginia Worker’s Compensation Commission – D’s

Date of Injury: This is the date the worker was injured at work or diagnosed with an occupational disease. Claims for benefits must usually be filed within two years from the date of the injury. Some exceptions, which your Virginia worker’s compensation lawyer should know, may apply.

 

Date of Accident: See Date of Injury.

 

Death Benefits: When an employee tragically dies due to a work injury, some family members may be entitled to the worker’s wage loss benefits. Usually the surviving spouse, children under 18 and children under 23 enrolled full time in an accredited educational institution can claim death benefits. Some destitute parents and other qualifying dependents may also qualify. Death benefits include funeral expenses up to $10,000 and transportation costs up to $1,000. This does not include the compensation payments.

 

Defendant: The party; normally, the employer, claim administrator, or insurance carrier, opposing an injured worker’s claims for benefits or services.
