Glossary of Virginia Worker’s Compensation Commission – E’s

Electronic Data Interchange (EDI): “The method used to exchange data electronically between the Commission and those organizations submitting claim reports to the Commission.”

 

Employee: “Every person, including aliens and minors, in the service of another under any contract of hire or apprenticeship, written or implied, where lawfully or unlawfully employed.” Smaller employers, with three employees or less in regular service, may be exempt from the state Workers’ Compensation Act.

 

Employer: The person or entity with control over your work activities. Control is one of the key factors in distinguishing between employee status and independent contractor status.

 

Employer’s Application: A form used by the Employer/Claim Administrators to suspend or terminate an injured workers benefits or request other relief from the Commission.

 

Endorsement – Essentially a change to an insurance policy. Endorsements may add coverage for things not covered in the original policy.

 

Executive Officer: “Means (i) the president, vice-president, secretary, treasurer or other officer, elected or appointed in accordance with the charter and bylaws of a corporation and (ii) the managers elected or appointed in accordance with the articles of organization or operating agreement of a limited liability company.” Some exceptions may apply for nonprofit of charitable officers.

 

Expedited Hearing: In some cases of severe economic hardship, an injured worker who is already under an Award can, in writing, request a faster hearing than is normal. This is done through an Expedited Hearing request form.

 

Experience Modifier: Another factor that helps set the price of the employer’s workers’ compensation insurance policy. It is a comparison among companies of similar size and type as to how many claims have been filed and what payments have been awarded. It is an incentive of lower prices for employers – to make safety a high priority.
