VIRGINIA WORKERS COMPENSATION COMMISSION GLOSSARY – Preliminary Terms

The Virginia Worker’s Compensation Commission has a glossary of relevant terms. The definitions are not legal advice. They are just guides. For precise definitions, it is best to consult with an experienced Virginia work injury lawyer.

 

20-day Order Claim Filed: After an injured worker makes a request for benefits, an official court document orders that the Claim Administrator, Insurance Carrier and/or Designated Representative must respond by either accepting or denying the benefit request within 20 days.

 

20-day Order Payments Made: This document is created when the total medical bills paid are more than $3,500 and no Award has been entered. It is also generated if wage loss is paid and the Commission has not Award on record. The Claim Administrator has 20 days to respond.

 

500-weeks: Injured workers can only obtain up to 500 weeks of Temporary Total Disability and/or Temporary Partial Disability unless the worker has been determined by the Commission to have a permanent and total incapacity. The permanent and total category is only reserved for certain injuries. Most typically, to be totally and permanent disabled, you must have two ratable body parts which have been permanently injured and rated.
