Virginia Workers’ Compensation Glossary – Definitions Starting with F

Family and Medical Leave Act (FMLA): This law allows qualified employees the right take off without pay to care for specific family members, including the worker himself/herself. During the time off, the person’s health insurance should normally continue as if the employee was working.

 

Fee Schedule: Virginia does not have a fee schedule for medical care. Generally, the employee will be paid for medical care through the employer’s insurance policies. When disputes arise as to what medical fee is proper – that dispute is usually between the medical provider and the employer’s insurance company. Exceptions may apply which an experienced Virginia worker’s compensation lawyer can explain.

 

Filing: Most forms , along with relevant medical records, need to be properly filed with the Virginia Workers’ Compensation Commission in order to proceed with your claim. It’s best to work with an experienced Virginia work injury lawyer to make sure the proper forms are filed, at the proper time, and in the proper manner. If you are computer savvy, the best way to do this is through the Commission’s webfile system.
