COLA Benefits in Virginia Worker’s Compensation Cases

In order to get cost of living adjustments (COLA benefits), the employee has to file a YEARLY COLA benefit form. The employee completes the basic information. A Social Security representative must complete some of the sections even if the claimant is not getting Social Security benefits. Note that if this is not done, the COLA will not be awarded by the Commission.

The form includes the worker’s name, address and Social Security Number (SSN). It states whether the employee is getting Social Security disability benefits. If the employee is getting Social Security disability benefits, then the monthly amount of the benefits, the Medicare monthly deduction and the net figure must be completed.

After the Social Security representative completes and signs the form, the form still needs to be filed with the Virginia Workers’ Compensation Commission
