File the Right Form to Claim Benefits if Injured at Work in Virginia

Workers should always file a claim for benefits even if the employer has agreed that benefits should be paid and has begun making payments. The employer may change its mind or assert that the employee is able to return to work. The completed and filed form protects the employee’ right to benefits. The precise timing of when to file this form is critical.

Part A of the form details the claim itself. It includes information about

  • The employee – name and address and other information such as phone numbers
  • The employer – name and address and other information such as phone numbers
  • The parts of the body that were injured-this is particularly important
  • How the injury happened
  • Where the injury happened
  • The employee’s weekly wages

This part also states whether the claim is based on an occupational disease. If a disease claim is made; the form should include the name of the disease, when your doctor said the disease began, and your last day of work for this employer

Part B of the form is the actual claim for benefits. The claimant will select all of the following that apply:

  • A request for lifetime medical benefits (including past treatment)
  • A claim for lost wages (past and ongoing)
  • A claim for compensation because of lower pay due to the injury, otherwise known as partial disability. (past and ongoing)
  • loss of hearing/vision, lung disease or bodily scarring/disfigurement.
  • A request for payment of unpaid medical bills including prescriptions and transportation
  • A request of death benefits to dependents or funeral expenses.
  • A change in disability status

 

Where relevant, key medical records and work notes, should be attached.
